TRANSPORTED SEMEN CONTRACT FOR 2004

I agree to conform to all policies, fees and guidelines set forth by Bitterroot Mule Company in this contract for the following jack:

q       Bitterroot Just In Time

q       Bitterroot Colorado Red

q       Bitterroot Strawberry Stretch       

1.       I understand that in addition to the breeding fee of $350.00, I will be responsible for all costs of the semen shipping process, including lab and handling fees, shipping container charge, and freight, each time semen is shipped. I agree to make all arrangements and payments due prior to semen shipment.

2.       The following must be in the Bitterroot Mule Company office at least five (5) days prior to actual shipment:

a.          Signed copy of Transported Semen Contract

b.          Shipped Semen breeding fee: (One time fee) $350.00 

c.          Shipping container charge: There are two methods of shipping fresh cooled semen: 

1.       For a $40.00 (non-refundable) fee a disposable Bioflite Styrofoam container is available which does not have to be returned. 

2.       Equitainers are available with a rental fee of $40.00 for the breeding season, plus a refundable deposit of $300.00.  The Equitainer should be returned within 3 days of the last insemination.  The deposit will be refunded upon notification of the Mare’s pregnancy.  Lost or damaged Equitainers containers are $300.00.

d.        Shipping charges (Call for exact charges. Fed Ex charge is approximately $65: 

3.       If mare does not settle on the first shipment of semen, a second shipment will be subject to the following costs:

·         Lab & semen handling fee, $50.00

·         Shipping container charge - $40.00

·         Shipping charges

4.       I agree to give at least a 24-hour working day notice on actual Semen Shipment. Fed Ex does not pick up or deliver on Sundays or holidays.

5.       On the first day of my mare’s heat cycle, I will notify Bitterroot Mule Company and have my Veterinarian check my mare and choose the date that my mare should be bred. I understand that palpation is of the utmost importance in choosing the proper breeding date in order to obtain the best results in getting my mare to foal. The shipping container will be shipped by overnight FED EX directly to my Veterinarian’s office. Bitterroot Mule Company will provide a two-(2) day insemination supply.

6.       I understand that the semen has been analyzed, tested, and is free from infectious disease. The sperm count, motility, collection and packaging practices meets or exceeds industry standards. Bitterroot Mule Company will enclose a data sheet with each shipment with the pertinent collection and semen information. A veterinarian should check motility upon arrival after proper warming procedures.

7.       I agree to have my mare examined by an early ultrasound scan between 14 and 18 days from the last day inseminated and notify Bitterroot Mule Company of her pregnancy status. It is suggested that she be pregnancy checked again by manual palpation at 45 days.

8.       I understand that the burden of conception is placed on me (the mare owner), and my veterinarian or technician. I understand that the mare must be bred immediately, on the same day semen is received, and proper methods of handling must be used.

9.       I understand that Bitterroot Mule Company shall not be held liable for delays in delivery, or semen that is lost in shipment or mishandled in any manner after it leaves the breeding farm. Furthermore, I hold Bitterroot Mule Company harmless of any claims of harm of any kind, which might be associated in any way with the transported cooled semen. Any disputes arising out of this contract shall be settled under the laws of the state of Colorado and arbitrated in Arapahoe County.

10.   I agree that only the mare designated on this contract will be inseminated with the shipped semen. A Breeder’s Certificate will be issued following the birth of the foal.

11.    “Return Privilege Guarantee”

·         If mare miscarries or aborts midterm, or foal is born dead and owner has proof that mare has received the Rhino Vaccinations (5th, 7th and 9th month of pregnancy), there are return privileges for the following season only.  Breeder must be notified within 10 days and must receive a veterinarian certification that the mare is open

·         If the mare should prove barren, Mare Owner has the privilege to continue breeding her during the remainder of the current breeding season or the following year ONLY

A rebreeding of the mare will only be honored through the following breeding season.  Rebreeds are subject to the rates as stated above in Paragraph 3.
